NOTICE OF TRUSTEE'S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated May 28, 2003, and the Deed of Trust of even date securing the same, recorded May 30, 2003, in Book No. T568, at Page 682, and modified on April 7, 2016, In Book No. T950, At Page 480 in Office of the Register of Deeds for Coffee County, Tennessee, executed by Wendy R. Cooley, conveying certain property therein described to Thomas L. Moser as Trustee for Mortgage Electronic Registration Systems, Inc., as nominee for New South Federal Savings Bank, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by Ditech Financial LLC.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Ditech Financial LLC, will, on February 19, 2019 on or about 10:00 AM, at the Coffee County Administrative Plaza, Manchester, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Coffee County, Tennessee, and being more particularly described as follows:
A certain tract or parcel of land located in the 9th Civil District of Coffee County, Tennessee and being more fully described as follows, to-wit: Being all of Lot No. 98 of the Bel-Aire Addition to the City of Tullahoma, Tennessee, according to a map or plat thereof of record in Trust Deed Book 70, Page 566, Register's Office, Coffee County, Tennessee; and being more particularly described as follows: Beginning at a point in the Southerly margin of the right-of-way of Woodlawn Street where it intersects with the Westerly margin of Stone Boulevard; thence in a Southeasterly direction on a tangent, the radius of which is 478.34 feet and the length of which is 140.50 feet along the Westerly margin of the right-of-way of Stone Boulevard, to I.P.M.; thence South 60 degrees 0 minutes 0 seconds West, 119.72 feet to I.P.O.; thence North 22 degrees 30 minutes 0 seconds West, 163.55 feet to I.P.O. in the southerly margin of the right-of-way of Woodlawn Street; thence on a tangent in an Easterly direction with a radius of 574.3 7 feet and a length of 20.87 feet, along the Southerly margin of the right-of-way of Woodlawn street to a point; thence North 71 degrees 4 minutes 23 seconds East, continuing along the Southerly margin of the right-of way of Woodlawn Street, 87.82 feet to the point of beginning; all according to a survey of James Trott and Miles Smith, dated October 10, 1989.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes;
any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee's option at any time.
