Default having been made in the terms, conditions and payments provided for in a Deed of Trust executed by Charles E. Tuck and Joyce E. Tuck, to Kenneth Kirby, Trustee for Coffee County Bank, dated March 15, 2002, and recorded in Trust Deed Book 521, page 822, and as modified by Modification Agreement executed by Joyce E. Tuck and husband, Ken Gorby, dated March 13, 2014, and recorded in Trust Deed Book 901, page 682, both in the Register's Office of Coffee County, to secure the indebtedness therein described, and

The original Trustee being unable to serve, and the holder of the indebtedness having exercised the authority given it in the Deed of Trust, nominated and appointed Shawn C. Trail, Attorney, to serve as Substitute Trustee (TDB 1044/500), and

The holder of said indebtedness having demanded payment, which is past due and unpaid and said payment not having been made; and holder having giving required notices pursuant to T.C.A. 35-5-101, and

Now, therefore, I, Shawn C. Trail, Attorney, Substitute Trustee, having been directed to do so by the owner of said indebtedness and by virtue of the power and authority vested in the Trustee in said Deed of Trust will on the 23rd day of May, 2019, at 11:00 A.M. at the south door of the Courthouse in Manchester, Coffee County, Tennessee, sell to the highest bidder for cash, free from the equity and statutory rights of redemption and subject to all matters shown on any recorded plan; any unpaid taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; and any matter that an accurate survey might disclose, the following described property located in the Eighth Civil District of Coffee County, Tennessee:

Beginning at a point in the northerly margin of Deans Shop Road, said point being the southernmost corner of the Levon Tuck 50 foot driveway where is intersects Dean shop Road, thence with Levon Tuck's southeasterly direction a distance of 835 feet to a point in the southwesterly line of G.W. Oakley where it intersects with the eastern corner of Lot 13; thence in a southeasterly direction with the G.W. Oakley line a distance of 312 feet to the northernmost point of a Levon Tuck .6 acre tract which is referred to as Lot 23; thence in a southwesterly direction along the northwesterly margin of Lots 23, 21, 19, 17 and 15, 805 feet to a point in the northerly margin of Dean Shop Road; thence with the margin of Dean Shop Road in a northwesterly direction 536 feet to the point of beginning, and containing 7.88 acres, more or less. This tract is bounded on the northwest by Levon Tuck, on the northeast by G.W. Oakley, on the southeast by Levon Tuck's tract containing Lots 15 through 24, and on the southwest by Dean Shop Road.

And being the same property conveyed to Charles E. Tuck and wife, Joyce E. Tuck, by Warranty Deed from Ernie Tuck and wife, Sharon Tuck, dated June 9, 1999 and recorded on June 14, 1999 at 8:05 A.M. in Warranty Deed Book 269, page 781, Register's Office of Coffee County, Tennessee. Charles E. Tuck is now deceased having died August 11, 2009, leaving Joyce E. Tuck sole survivor of tenancy by the entireties. See also Deed Creating Tenancy by the Entireties from Joyce E. This property is located at 4002 Deans Shop Road, Estill Springs, Tennessee, and shown as Map 131, Parcel 003.01 in the Property Assessor's Office of Coffee County, Tennessee.

Notice is also given to Al Knowles, c/o A. Colbrook Baddour, P.O. Box 296, 123 South First Street, Pulaski, Tennessee 38478, who filed a subsequent judgment lien in Lien Book 21, page 471, Register's Office of Coffee County.
