SUBSTITUTE TRUSTEE'S NOTICE OF SALE

KNOW ALL MEN BY THESE PRESENTS:

THAT, WHEREAS, on the 22TH day of January, 2015, Michael E. Grant, by Deed of Trust, and recorded January 26, 2015, in Trust Book T1142, Page 487, et seq., Register's Office of Franklin County, Tennessee, as amended by an Estoppel and Modification Agreement dated September 24, 2015 and recorded October 5, 2015 in Trust Book T1165, Page 25 et seq., Register's Office of Franklin County, Tennessee and Amended Deed of Trust dated January 28, 2016 and recorded February 1, 2016 in Trust Book T1175, Page 239, et seq., Register's Office of Franklin County, Tennessee, did convey in trust to Dennis Walker, the real estate hereinafter described to secure the payment to Citizens Community Bank certain promissory notes in said Deed of Trust, Estoppel and Modification Agreement and Amended Deed of Trust, being incorporated therein by reference, and;

WHEREAS, said Deed of Trust, Estoppel and Modification Agreement and Amended Deed of Trust provides that in event of default of payment of any of said note or notes and interest, when due, or failure to satisfy taxes or insurance the entire indebtedness may, at the option of the holder and owner of the note, become due and payable, and;

WHEREAS, default has been made in the payment of said indebtedness or taxes or insurance secured by the aforesaid Deed of Trust, Estoppel and Modification Agreement and Amended Deed of Trust and the holder and owner of said notes has decreed the entire indebtedness due and payable and has instructed the undersigned Substitute Trustee to foreclose upon that property located in Franklin County, Tennessee as described in said Deed of Trust, Estoppel and Modification Agreement and Amended Deed of Trust, and;

NOW, THEREFORE, by the authority in me vested as Substitute Trustee, said Appointment of Substitute Trustee being of record in the Register's Office of Franklin County, Tennessee at Trust Book T1313, Page 279, et seq., I will, at 10:00 A.M. on the 10TH day of February, 2020, offer for sale and sell the subject property at the West door of the Franklin County Courthouse on the public square in Winchester, Tennessee to the last, highest and best bidder, for cash in hand, and in bar of equity of redemption the property herein described lying and being in the 9TH Civil District of Franklin County, Tennessee, and being more particularly described as follows, to-wit:

BEGINNING at an iron pin found in the northwest margin of the Old Alto Highway, a 50 feet wide public right-of-way, said pin lying at the southeast corner of Miller (DB 314, P. 497, ROFCT), and said pin lying at the southwest corner of the parent parcel from which this tract is carved; thence leaving the Old Alto Highway, and along the east and north lines of Miller North 11 degrees 55 minutes 37 seconds West 188.27 feet to an iron pin found; and South 74 degrees 42 minutes 37 seconds West 197.93 feet to an iron pin set; thence following a wire fence and the east line of Rose (DB 181, P. 715, ROFCT) North 09 degrees 48 minutes 15 seconds West 497.93 feet to an iron pin set; thence with a dividing line and remaining lands of Patton North 74 degrees 18 minutes 03 seconds East 179.53 feet to an iron pin set; South 11 degrees 55 minutes 37 seconds East 87.15 feet to an iron pin set; North 74 degrees 14 minutes 57 seconds East 244.12 feet to an iron pin set; South 11 degrees 28 minutes 12 seconds East 407.58 feet to an iron pin set; and South 13 degrees 48 minutes 58 seconds East 54.34 feet to an iron pin set in the northwest margin of the Old Alto Highway; thence along the margin of said highway South 45 degrees 03 minutes 16 seconds West 113.29 feet to an iron pin set; and South 46 degrees 10 minutes 32 seconds West 173.30 feet to the Point of Beginning, and containing 5.099 acres, according to a survey by Thomas M. Ore, TN RLS No. 1610, January 13, 2015, Job # 1501070.

Subject to a 40 feet wide easement for an overhead telephone line as shown on said survey.

Subject to driveway easement filed of record in Book 277, Page 20, Register's Office of Franklin County, Tennessee.

Being the same property conveyed unto Michael E. Grant by deed of record in Book 402, Page 459, Register's Office of Franklin County, Tennessee.

PROPERTY ADDRESS: The street address of the above-described property is believed to be 8755 Old Alto Hwy., Decherd, Franklin Co., Tennessee but such address is not a part of the legal description of the property sold herein and in the event of any discrepancy, the legal description herein shall control.

The sale of the above-described property shall be subject to unpaid property taxes, or other taxes, assessments, subdivision restrictions, building lines, easements, and all prior liens and encumbrances of record superior in right to the said Deed of Trust, Estoppel and Modification Agreement and Amended Deed of Trust.

The right is reserved to adjourn the day of sale to another day and time certain, without further publication and in accordance with law, upon announcement of said adjournment on the day and time and place of sale set forth above.

All right and equity of redemption, statutory or otherwise, homestead and dower are expressly waived in said Deed of Trust, Estoppel and Modification Agreement and Amended Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.

Title is to be conveyed subject to all prior liens, easements, covenants, conditions, encumbrances and restrictions that may exist including, without limitation, any unpaid real property taxes or personal property taxes.
