SUBSTITUTE TRUSTEE'S NOTICE OF SALE
KNOW ALL MEN BY THESE PRESENTS:
THAT, WHEREAS, on the 8TH day of December, 2017, Michael Hall and wife, Misty D. Hall, by Deed of Trust recorded December 18, 2017, in Trust Book T1238, Page 641, et seq., Register's Office of Franklin County, Tennessee, did convey in trust to Dennis Walker, the real estate hereinafter described to secure the payment to Citizens Community Bank certain promissory note in said Deed of Trust, being incorporated therein by reference, and;
WHEREAS, said Deed of Trust provides that in event of default of payment of any of said note or notes and interest, when due, or failure to satisfy taxes or insurance the entire indebtedness may, at the option of the holder and owner of the note, become due and payable, and;
WHEREAS, default has been made in the payment of said indebtedness or taxes or insurance secured by the aforesaid Deed of Trust and the holder and owner of said notes has decreed the entire indebtedness due and payable and has instructed the undersigned Substitute Trustee to foreclose upon that property located in Franklin County, Tennessee as described in said Deed of Trust, and;
NOW, THEREFORE, by the authority in me vested as Substitute Trustee, said Appointment of Substitute Trustee being of record in the Register's Office of Franklin County, Tennessee at Trust Book T1316, Page 165, I will, at 10:00 A.M. on the 12TH day of March, 2020, offer for sale and sell the subject property at the West door of the Franklin County Courthouse on the public square in Winchester, Tennessee to the last, highest and best bidder, for cash in hand, and in bar of equity of redemption the property herein described lying and being in the 5TH Civil District of Franklin County, Tennessee, and being more particularly described as follows, to-wit:
Beginning at a #5 rebar set with a cap stamped JOHNSON ASSOC TN RLS 1632 (all such points herein after referred to as a capped rebar set) in the South boundary of the 30' right-of-way of Murray Road at the Northwest corner of the herein described tract, said point being further described as being the Northeast corner of the 7.78 acre Tract #3 and being located South 85 degrees 49 minutes 10 seconds East, 1960.21 feet from the centerline intersection of Walnut Hill Road and Murray Road, Thence from the Point of Beginning with Murray Road along a curve to the right having a radius of 335.46 feet, a delta angle of 27 degrees 00 minutes 04 seconds, a chord bearing of South 48 degrees 42 minutes 23 seconds East, and a chord distance of 156.63 feet, for an arc length of 158.09 feet to a capped rebar found, Thence South 35 degrees 12 minutes 21 seconds East, 127.30 feet to a capped rebar found at a point of curvature, Thence along a curve to the left having a radius of 176.60 feet, a delta angle of 26 degrees 32 minutes 12 seconds, a chord bearing of South 50 degrees 24 minutes 55 seconds East, and a chord distance of 81.06 feet, for an arc length of 81.79 feet to a capped rebar set at the Northwest corner of the 16.91 acre Tract #1, Thence with Tract #1 South 00 degrees 45 minutes 18 seconds East, 207.81 feet to a capped rebar set, Thence North 89 degrees 54 minutes 55 seconds West, 257.74 feet to a capped rebar set at the Southeast corner of said Tract #3, Thence with Tract #3 North 00 degrees 10 minutes 43 seconds East, 466.45 feet to the Point of Beginning. Said Tract contains 2.01 acres, more or less as surveyed by Kurt M. Johnson, TN RLS #1632, dated November 7, 2011.
Being the same property conveyed unto Michael Hall and Misty D. Hall by deed dated June 10, 2016 and filed of record in Book 412, Page 386, Register's Office of Franklin County, Tennessee.

PROPERTY ADDRESS: The street address of the above-described property is believed to be 520 Murray Rd., Belvidere, Franklin Co., Tennessee but such address is not a part of the legal description of the property sold herein and in the event of any discrepancy, the legal description herein shall control.
The sale of the above-described property shall be subject to unpaid property taxes, or other taxes, assessments, subdivision restrictions, building lines, easements, and all prior liens and encumbrances of record superior in right to the said Deed of Trust.
The right is reserved to adjourn the day of sale to another day and time certain, without further publication and in accordance with law, upon announcement of said adjournment on the day and time and place of sale set forth above.
All right and equity of redemption, statutory or otherwise, homestead and dower are expressly waived in said Deed of Trust.
Title is to be conveyed subject to all prior liens, easements, covenants, conditions, encumbrances and restrictions that may exist including, without limitation, any unpaid real property taxes or personal property taxes.
THIS IS AN ATTEMPT TO COLLECT A DEBT, AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
