SUBSTITUTE TRUSTEE'S NOTICE OF SALE
KNOW ALL MEN BY THESE PRESENTS:
THAT, WHEREAS, on the 11TH day of March, 2011 by Deed of Trust, of record in Trust Book T1018, Page 329, et seq., Register's Office of Franklin County, Tennessee, James Travis Miller, did convey in trust to Dennis Walker, Trustee, the real estate hereinafter described to secure the payment to Citizens Community Bank a certain promissory note in said Deed of Trust, being incorporated therein by reference; and
WHEREAS, said Deed of Trust provides that in event of default of payment of any of said note or notes and interest, when due, or failure to satisfy taxes or insurance the entire indebtedness may, at the option of the holder and owner of the note, become due and payable, and;
WHEREAS, default has been made in the payment of said indebtedness or taxes or insurance secured by the aforesaid Deed of Trust and the holder and owner of said notes has decreed the entire indebtedness due and payable and has instructed the undersigned Substitute Trustee to foreclose upon that property located in Franklin County, Tennessee as described in said Deed of Trust and;
NOW, THEREFORE, by the authority in me vested as Substitute Trustee, said Appointment of Substitute Trustee being of record in the Register's Office of Franklin County, Tennessee at Trust Book T1271, Page 432, I will, at 10:00 A.M. on Friday, the 4th day of January, 2019, offer for sale and sell the subject property by foreclosure auction with said auction to take place at the West door of the Franklin County Courthouse on the public square in Winchester, Franklin County, Tennessee, to the last, highest and best bidder, for cash in hand, and in bar of equity of redemption the property herein described lying and being in the 4TH Civil District of Franklin County, Tennessee, and being more particularly described as follows, to-wit:
BEGINNING at a stake in Stovall's South West Corner in public Road and runs thence in and with said road parallel with wire fence and One Rod from same, from same South 13 East 17- 7/9 Rods to a stone, thence North 13 West 9 poles to a stone. Thence with Stovall's South boundary North 79 West 17- 7/9 poles to beginning containing One acre more or less.
Being the same property conveyed unto James Travis Miller by deed of record in Book 377, Page 394, Register's Office of Franklin County, Tennessee.

The sale of the above-described property shall be subject to unpaid property taxes, or other taxes, assessments, subdivision restrictions, building lines, easements, and all prior liens and encumbrances of record superior in right to the Deed of Trust.
The right is reserved to adjourn the day of sale to another day and time certain, without further publication and in accordance with law, upon announcement of said adjournment on the day and time and place of sale set forth above.
All right and equity of redemption, statutory or otherwise, homestead and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.
Title is to be conveyed subject to all prior liens, easements, covenants, conditions, encumbrances and restrictions that may exist including, without limitation, any unpaid real property taxes or personal property taxes.
