SUBSTITUTE TRUSTEE'S SALE
Default having been made in the terms, conditions and payments provided for in a Deed of Trust executed by Monty Craig Barnes and Beauman Barnes, to Kenneth C. Kirby, Trustee for Coffee County Bank, dated September 6, 2012, and recorded in Trust Deed Book 865, page 997, and as modified by Modification Agreements dated June 14, 2013, of record in Trust Deed Book 884 Page 342, Registers Office Of Coffee County Tennessee; dated August 21, 2017, of record in Trust Deed Book 995 Page 310, all in the Registers Office Of Coffee County Tennessee, to secure the indebtedness therein described, and
The holder of the indebtedness having exercised the authority given it in the Deed of Trust, nominated and appointed Shawn C. Trail, Attorney, to serve as Substitute Trustee (TDB 1065/860), and
The holder of said indebtedness having demanded payment, which is past due and unpaid and said payment not having been made; and holder having giving required notices pursuant to T.C.A. 35-5-101, and
Now, therefore, I, Shawn C. Trail, Attorney, Substitute Trustee, having been directed to do so by the owner of said indebtedness and by virtue of the power and authority vested in the Trustee in said Deed of Trust will on the 18th day of December, 2019, at 11:00 A.M. at the south door of the Courthouse in Manchester, Coffee County, Tennessee, sell to the highest bidder for cash, free from the equity and statutory rights of redemption and subject to all matters shown on any recorded plan; any unpaid taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; and any matter that an accurate survey might disclose, the following described properties located in the First Civil District of Coffee County, Tennessee:
BEING all of Tract Number One (1) and a portion of Tract Number Two (2) in the subdivision of the farm of Herman Rigney, according to a plat thereof recorded in Trust Deed Book 89, page 297, Register=s Office of Coffee County, Tennessee, being more particularly described as follows, to wit:
BEGINNING at an iron pin at a corner post in the west margin of Old Woodbury Road, the same point being Rigney=s northeast corner, the same point being the southeast corner of Tract No. 1, according to a plat thereof recorded in Trust Deed Book 89, page 297, Register=s Office of Coffee County, Tennessee; thence from said point of beginning north 86 deg. 54.5 min. west 2096.78 feet to a planted stone on the east bank of the Duck River; thence north 86 deg. 54.5 min. west 35.0 feet to the center line of the Duck River; thence along the center line of the Duck River north 01 deg. 14 min. west 314.18 fee to a point in the center line of the Duck River; thence north 88 deg. 02.5 min. east 34.90 feet to a post on the east bank of the Duck River; thence north 88 deg. 02.5 min. east 1142.90 feet to a corner post; thence south 00 deg. 51 min. east 282.35 feet to an iron pin at a corner post; thence south 88 deg. 41 min. east 917.89 feet to a corner post in the west margin of Old Woodbury Road; thence along the west margin of Old Woodbury Road south 12 deg. 22 min. east 169.98 feet to the point of beginning and containing 13.10 acres as surveyed by Alton C. Morris, PE Tennessee No. 3478, on December 12, 1977.
INCLUDED IN THE ABOVE DESCRIBED REAL PROPERTY, BUT EXPRESSLY EXCLUDED THEREFROM is 1.25 acres conveyed to Craig Barnes and wife, Beth Barnes, by Warranty Deed from Beauman L. Barnes and wife, Philomena C. Barnes, dated November 30, 2000 and recorded on December 4, 2000 at 3:50 P.M. in Warranty Deed Book 278, page 822, Register=s Office of Coffee County, Tennessee.
And being the same property conveyed to Beauman L. Barnes and wife, Philomena C. Barnes, by deed from Ernest L. Snyder and wife, Mary Lorene Snyder, dated September 22, 1997 and recorded on September 22, 1997 at 4:00 P.M. in Warranty Deed Book 163, page 20, Register's Office of Coffee County, Tennessee. Philomena Barnes predeceased Beauman L. Barnes, having died intestate June 1, 2001, leaving him sole survivor of the tenancy by the entireties. Beauman L. Barnes is now deceased, having died January 20, 2015, survived by his son, Monty Craig Barnes.
This property is located 179 Barnes Lane, Manchester, Tennessee 37355, and shown as Map 058, Parcel 001.02, in the Property Assessor's Office of Coffee County, Tennessee.
Notice is also given to Occupant(s), 179 Barnes Lane, Manchester, TN 37355; and State of TN, Bureau of TennCare, 310 Great Circle Rd., 3rd Floor, Nashville, Tennessee 37243
