KNOW ALL MEN BY THESE PRESENTS:
That Whereas, by Deed of Trust dated the 24th day of September, 2012, of record in the Register's Office of Moore County, Tennessee, in Trust Deed Book 135, page 237, Margaret A. Shumake and William Nelson, did convey in trust to Wallace Rowland, Trustee for Peoples Finance Co., Inc., the tract of land hereinafter described to secure the payment of the principal sum of Forty Thousand & 00/100 ($40,000.00) Dollars, evidenced by the certain Promissory Note in said Deed of Trust being incorporated by reference; and
Whereas, said Deed of Trust provides for the appointment of a Substitute Trustee; and by instrument of record in Trust Deed Book 154, page 50, in the Register's Office of Moore County, Tennessee, James D. Lane, II, has been duly appointed Trustee; and
Whereas, said Deed of Trust provides that in the event of default in payment of any of said note and interest, when due, the entire indebtedness shall, at the option of the holder and owner hereof, become due and payable; and
Whereas, default has been made in the payment of certain installments of said indebtedness now due on said Note, and the holder and owner of said Note has declared the entire balance, including penalty, cost and expense incident to foreclosure, now due and payable, and instructed the undersigned James D. Lane, II, Trustee, to foreclose the said Deed of Trust.
Whereas, pursuant to TCA 35-5-117, the Trustee did send a Notice of Right to Foreclose to the debtor's last known mailing address on March 15, 2019; and
NOW, THEREFORE, by virtue of the authority in me vested as Trustee under said instruments, I will, on the 24th day of April, 2019, offer for sale and sell at the Main Door of the Courthouse in Moore County, Tennessee at 10:00 a.m. to the last, highest, and best bidder for cash in hand, and in bar of equity of redemption, homestead and dower, and all other exemptions of every kind which are expressly waived in said Deed of Trust, the following described tract of land situated in the Second (2nd) Civil District of Moore County, Tennessee, and being more particularly described as follows:
Beginning at an old iron pin lying on the west margin of Griffin Road (50' R.O.W) also being the southeast corner of Sanders (DB 52, P. 430, ROMCT); thence with Griffin Road South 14 degrees 29 minutes West 106.7 feet to a new iron pin; thence South 15 degrees 50 minutes West 131.5 feet to a new iron pin; thence South 16 degrees 16 minutes West 194.7 feet to a new iron pin; thence South 14 degrees 12 minutes West 100.4 feet to a 10-inch black oak; thence leaving the road and with Leader Federal S & L (DB 48, P. 798, ROMCT) North 37 degrees 57 minutes West 125.3 feet to an old iron pin; thence with Vaughn (DB 3, P. 474, ROMCT) North 34 degrees 47 minutes West 503.8 feet to a 36-inch oak and beech; thence with Sanders' south line North 55 degrees 23 minutes East 89.7 feet to an 18-inch red oak; thence South 79 degrees 05 minutes East 170.6 feet to a 10-inch oak; thence South 77 degrees 28 minutes East 106.6 feet to a 24-inch oak; thence South 79 degrees 17 minutes East 116.6 feet to a 10-inch oak; thence North 59 degrees 03 minutes East 53.7 feet to the point of beginning, and containing 3.16 acres, according to a survey prepared by Chris Bateman of 1300 Smith Chapel Drive, Shelbyville, Tennessee 37160, on April 17, 2001.
Being the same property conveyed to William Nelson and Margaret A. Shumake, tenants in common with rights of survivorship, by Warranty Deed recorded on August 16, 2002 in Deed Book 61, page 425, Register's Office of Moore County, Tennessee.
Said sale is made subject to all oral announcements made at the sale.
Said sale is subject to any and all outstanding liens or encumbrances and/or any unpaid Moore County real property taxes, including but not limited to the 2016 Moore County real property taxes which are delinquent and due and payable in the base amount of $277.00 ($465.57 through March 31, 2019); the 2017 Moore County real property taxes which are delinquent and due and payable in the base amount of $277.00 ($331.02 through March 31, 2019 and set to go to the Moore County Clerk & Master on April 1, 2019) and the 2018 Moore County real property taxes which are delinquent and due and payable in the base amount of $241.00 ($244.62 through March 31, 2019).
The following lien against subject property is subordinate to the above-referenced Deed of Trust on the subject property:
Judgment Lien against Margaret Ann Shumake in the amount of $5,746.66, due and payable to Credit Acceptance Corporation, admitted on January 16, 2001 and recorded on March 24, 2004 in Misc Book 7, page 365, Register's Office of Moore County, Tennessee. Said Judgment Lien was extended for an additional ten (10) years by Order Extending Judgment for an Additional Ten Years admitted on March 3, 2011 and recorded on May 27, 2011 in Misc. Book 9, page 206, Register's Office of Moore County, Tennessee.
